1. Accounts & Access

We sign you in using a one-time link sent to your email address — there are no passwords to remember. You are responsible for keeping access to your email account secure. Access to a child’s photographs requires you to be signed in and to confirm that you are that child’s parent or legal guardian.

2. Linking a Child & Photo Matching

To view a child’s photographs you link them to your account by entering their first name, last name, and date of birth. By linking a child you confirm that you are that child’s parent or legal guardian. We rely on the details you provide to match photographs to your account. Please check carefully that the photographs shown are of your child before placing an order. We are not liable for orders placed against photographs that were matched using inaccurate details you supplied.

3. Orders & Pricing

Available products — prints, digital downloads, and packages — and their prices are shown at checkout in South African Rand (ZAR). An order is only confirmed once full payment has been received. We may correct any obvious pricing or product error before fulfilling an order; if we do, we will let you know and offer you the choice to proceed or cancel for a full refund.

4. Payment

Payments are processed securely through PayFast. We never see or store your card details. Your order is confirmed by email once payment is successful.

5. Delivery

Digital downloads are made available to you after successful payment. Printed products are produced to order and delivered or made available for collection within the timeframe communicated at checkout, or within 30 days of your order where no specific timeframe is given. Where circumstances within our control prevent us from delivering your order, our maximum liability is a full refund of the amount paid for that order.

6. Cancellations & Refunds

Prints and digital downloads are produced specifically to your order. In line with section 17 of the Consumer Protection Act 68 of 2008, goods made to your specifications are non-refundable once an order has been placed and paid for. Digital downloads are non-refundable once they have been made available to you.

As a courtesy, if you contact us before production of a printed order has begun, we will use reasonable efforts to amend or cancel it — this is at our discretion and is not guaranteed once production is underway.

Nothing in this section limits your statutory rights. If goods arrive defective, damaged, or not as described, you are entitled to a repair, replacement, or refund in accordance with section 56 of the Consumer Protection Act. To raise any of these, get in touch.

7. Copyright & Usage

GoodContent (Pty) Ltd, trading as Lad & Lass Photography, retains full copyright in all photographs. Purchasing prints or digital downloads grants you a non-exclusive, non-transferable licence to use the images for personal, non-commercial purposes only — such as printing for your family and sharing privately.

You may not resell, sublicense, publish for commercial gain, or alter the photographs beyond personal use. Digital files you purchase may be printed for your own personal use.

8. Liability

Our liability in connection with any order is limited to the amount paid for that order. We are not liable for any indirect, consequential, or incidental loss arising from your use of this platform or any order placed through it.

9. Governing Law

These terms are governed by the laws of the Republic of South Africa, and any disputes will be subject to the jurisdiction of the South African courts.

Children’s Personal Information

This platform necessarily processes the personal information of children — their names, dates of birth, and photographs. Under POPIA, a child’s personal information may only be processed with the consent of a competent person (the child’s parent or legal guardian).

The photography was arranged through the child’s school, which obtained the necessary consent from parents and guardians. When you link a child to your account, you confirm that you are that child’s parent or legal guardian and you consent to us processing their information for the purposes set out below. If you are not the child’s parent or legal guardian, you must not link the child or order their photographs.

As the competent person, you may exercise any of the rights set out under “Your Rights” below on the child’s behalf.

What We Collect

We collect only the information necessary to match photographs and process your orders:

• Your email address (used to sign you in)
• Your name, where you provide it
• Each linked child’s first name, last name, and date of birth (used to match their photographs)
• The photographs of your child taken at their school
• Your order and payment records
• Any details you voluntarily provide when contacting us

Why We Collect It

• To sign you in securely using a one-time email link
• To match and display your child’s photographs to your account
• To process, fulfil, and deliver your orders
• To send transactional emails (sign-in links, order confirmations)
• To respond to queries about your account or orders

We will not use your information for unsolicited marketing without your explicit consent.

Where Children’s Data Comes From

Student, class, and photograph data is provided to us by the child’s school in connection with the photography session arranged with that school. We use these details solely to match each child’s photographs to the correct parent or guardian.

Third-Party Processors

Your information is shared only with the following processors, each bound by their own privacy and security obligations:

• PayFast — payment processing (we do not store card details)
• Resend — transactional email delivery
• Cloudflare — hosting and infrastructure
• Xero — accounting and invoicing
• Google Analytics — anonymous website usage analytics

We do not sell or share your personal information with any other third parties.

Data Retention

We retain personal information and photographs only for as long as is necessary to fulfil the purposes for which they were collected and to meet our legal obligations. Photographs remain available for ordering for a limited period after the school session, after which they are removed. Order and financial records are retained for at least five years, as required by South African tax and accounting law.

Security

We take reasonable technical and organisational measures to protect personal information against unauthorised access, loss, or misuse. Our systems are hosted on Cloudflare’s infrastructure over encrypted connections (HTTPS), and sign-in links are single-use and time-limited.

Your Rights

Under POPIA, you (and, on their behalf, any child you are the guardian of) have the right to:

• Request access to the personal information we hold
• Request correction of inaccurate information
• Object to the processing of personal information
• Request deletion of information (subject to our legal retention obligations)
• Withdraw consent to processing a child’s information
• Lodge a complaint with the Information Regulator of South Africa
